The Petitioner, being the importer on record registered under Section 115 of the Customs Ordinance, had imported certain consignment of goods, part of which was not declared in the Customs Declaration form. It was investigated into since there was a mismatch between the Customs Declaration and the Bill of Lading and the packing list. After inquiry, the goods were ordered to be released on payment of Custom duty and certain penalty. Subsequently, the producing officer made an application to the Director General to revise the order and sought a direction under Section 2 read with Section 47 as well. After full-scale inquiry, penalty was imposed under Section 47; Petitioner challenges the same. Held – the Respondents’ actions are legal and justifiable, and the order made under Section 47 is justifiable as well.

Having failed to exercise the right of appeal to the Supreme Court in terms of section 14(2) of the Maintenance Act, to be read with sections 9(a) and 10 of the Act and Articles 154P(3)(b) and 138 of the Constitution, could the Petitioner invoke the extra-ordinary revisionary jurisdiction of this Court vested in it under Article 138 of the Constitution to revise and set aside an order made by a High Court of the Province in the exercise of the appellate jurisdiction vested in it by section 14(1) of the Maintenance Act, to be read with sections 4, 5 and 6 of the High Court of the Provinces (Special Provisions) Act, No. 19 of 1990 and Articles 154P(3)(b) and 138 of the Constitution in view of section 14(2) of the Maintenance Act to be read with sections 9(a) and 10 of the High Court of the Provinces (Special Provisions) Act, No. 19 of 1990.
